Service Terms for Creavide

By accessing or using any of Creavide’s services, you (“Client”) agree to be bound by these Service Terms (“Terms”). If you do not agree, please do not use our services.


1. Scope of Services

Creavide provides high-quality video post-production services, including but not limited to video editing, color correction, motion graphics, sound design, and other services as specified in the written agreement, proposal, or quote provided to the Client. The specific scope, timeline, and deliverables will be defined and mutually agreed upon prior to project commencement.


2. Collaboration and Communication

The Client agrees to cooperate in good faith by providing all necessary materials, information, and timely feedback required to complete the services efficiently. Communication will be conducted primarily via email or other agreed digital platforms unless stated otherwise in writing.


3. Intellectual Property Rights

The Client retains all intellectual property rights to any material submitted to Creavide for post-production. Creavide does not claim ownership over such content. Final deliverables shall become the property of the Client once full payment is received, except where otherwise agreed in writing.

Unless the Client explicitly opts out in writing, the Client grants Creavide a non-exclusive, worldwide, royalty-free license to showcase the final deliverables for promotional purposes, including on Creavide’s website, portfolio, and social media. If the Client prefers not to have their project used in this way, they may notify Creavide at any time in writing, and Creavide will comply accordingly.


4. Fees and Payment Terms

All fees shall be agreed upon in writing before project initiation. Prices are quoted in U.S. Dollars (USD) and are payable via Stripe, bank transfer, or any other method agreed upon.

For standard one-time projects, the Client agrees to pay 50% of the total project fee in advance, prior to the commencement of any work, and the remaining 50% upon delivery of the final version before any revision rounds begin. Revisions will not be started until the final balance has been paid in full.

For monthly retainer agreements, the Client agrees to pay the full monthly fee in advance, prior to the start of each service period.

Invoices are due upon receipt or within the payment period stated in the agreement, whichever applies. Any late payments may incur a 1.5% monthly interest or the maximum rate permitted by applicable law. Creavide reserves the right to suspend or withhold work and delivery of files in the event of late or non-payment.


5. Delivery and Revisions

Creavide will deliver work within the timelines and quality standards agreed upon. The Client is entitled to up to two (2) rounds of revisions per deliverable, provided that feedback is submitted within seven (7) calendar days of delivery.

Revisions refer to minor corrections or adjustments necessary to meet the originally agreed-upon scope, such as fixing errors, improving timing, or polishing visual or audio elements. Any significant changes in creative direction, scope, or content that deviate from the original agreement may be treated as a new project or billed separately.


6. Cancellations and Refunds

If the Client cancels the project after it has commenced, Creavide is entitled to compensation for all work completed and expenses incurred up to the cancellation date. Creavide does not offer refunds once the project has commenced. Any exception to this policy shall be at Creavide’s sole discretion and must be agreed in writing. Delays or cancellations caused by force majeure events (e.g., natural disasters, war, pandemics, etc.) will not constitute a breach of contract.


7. Limitation of Liability

To the fullest extent permitted by law, Creavide shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of revenue, profits, data, or use) arising out of or related to the services provided, even if advised of the possibility of such damages.


8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Jalisco, Mexico, without regard to conflict of law principles. Any dispute arising from or related to these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Guadalajara, Jalisco, Mexico. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.


9. Independent Contractor

Nothing in these Terms shall be construed to establish a partnership, joint venture, employment, or agency relationship between the Client and Creavide. Each party operates as an independent contractor.


10. Export Compliance

The Client agrees not to use Creavide’s services in violation of applicable export laws or regulations, including those of the United States and Mexico.


11. Updates to These Terms

Creavide reserves the right to update these Terms at any time. The updated version will be made available on www.creavide.com/terms-of-services/. Continued use of the services after such updates constitutes acceptance of the revised Terms. Material changes to these Terms will be communicated to Clients via email or published notice prior to becoming effective.
